Contaminated Land

The identification of environmental liabilities and the possible presence of contaminated land have now become a significant consideration in relation to land transactions and planning applications. Companies need to know the liabilities associated with their current landholdings and with any land or property they are considering acquiring. In particular, this is driven by the current regulatory regime including:
The implementation of Part IIA of the Environmental Protection Act 1990 within the body of the Contaminated Land Regulations 2000 which provides a new regulatory regime for the assessment of contaminated land, protection of water resources and the protection of human health; and
The requirements under the PPC regulations for an Application Site Report to provide a documented record of the condition of the land and associated groundwaters at the time that a PPC permit application is made and to provide a reference point against which any deterioration in land or groundwater quality can be assessed.
BMT Cordah Ltd has been working for a number of years conducting contaminated land assessments for a range of clients including banks, solicitors, local authorities, land owners and developers as well as existing industrial clients.
Each phase of work, from desk study through to site investigation and remediation, determines the requirements of the next and we therefore adopt a tiered approach to ensure the amount of work and expenditure is minimised. Under the regulations Local Authorities, the Environment Agency and SEPA are required to take on additional responsibilities in the assessment of potentially contaminated sites and BMT Cordah therefore undertake extensive consultation with these bodies. Contaminated land assessments are risk-based and carried out in line with BS10175:2001 and appropriate industry guidance.
The Application Site Report is a technical document which is used to inform decisions made in relation to the issue and surrender of PPC permits.
